Article 1 - Definitions

The following definitions apply in these terms and conditions:
1. Reflection period: the period during which the consumer can invoke his right of withdrawal;
2.Consumer: a natural person who is not acting in a professional or commercial capacity and who enters into a distance contract with the operator;
3.Day: calendar day;
4. Permanent data carrier: any device that enables the consumer or the operator to store information that is addressed to him personally in a way that allows for future consultation and unchanged reproduction of the stored information.
5. Right of withdrawal: the possibility for the consumer to back out of the distance contract during the reflection period;
6. Operator: a natural or legal person who offers products and/or services to consumers from a distance;
7. Distance contract: an agreement in which one or more telecommunication methods are used exclusively up to and including the conclusion of the agreement within the context of a system for the distance selling of products and/or services devised by the operator;
8. Telecommunication method: a means that can be used to conclude an agreement without the consumer and operator meeting in the same room at the same time.

Article 3 - Scope

1. These general terms and conditions apply to all offers from the operator and to all distance contracts concluded between operator and consumer.
2. Before concluding the distance contract, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, before concluding the distance contract the consumer will be notified that the general terms and conditions can be viewed at the operator's location and that they will be mailed as soon as possible at no cost at the consumer's request.
3. If the distance contract is concluded electronically, before the distance contract is concluded and in derogation of the preceding paragraph, the text of these general terms and conditions can be sent to the consumer electronically in such a way that it can be easily stored by the consumer on a permanent data carrier. If this is not reasonably possible, the consumer will be notified before concluding the distance contract where the general terms and conditions can be accessed electronically and that they will be sent to the consumer electronically or by other means at no cost at the consumer's request.
4. If specific product or service conditions apply in addition to these general terms and conditions, the second and third paragraphs apply mutatis mutandis; in the event of conflicting general terms and conditions, the consumer always has the right to invoke whichever applicable provision is more favourable to him.

Article 4 - Offer

1. If an offer is for a limited time only or is subject to certain conditions, this will be explicitly stated in the offer.
2. The offer contains a complete and accurate description of the offered products. The description is sufficiently detailed to enable the consumer to properly assess the offer. If the operator uses images, these images are faithful reflections of the offered products. The operator is not bound by apparent mistakes or apparent errors in the offer.
3.Every offer contains information that makes it clear to the consumer what rights and obligations are attached to acceptance of the offer. This applies in particular to:
the price including taxes;
any delivery costs;
the way in which the agreement will be concluded and what actions will be required;
whether or not the right of withdrawal applies;
the payment method, delivery and execution of the agreement;
the deadline for accepting the offer and the period within which the operator guarantees the price;
the telecommunication rate if the costs of using the telecommunication method are calculated on a different basis than the regular base rate for the used means of communication;
whether the agreement will be archived after it is concluded, and if so, how it can be consulted by the customer;
the way in which the consumer can check the data provided by him in the context of the agreement and correct them if necessary before the agreement is concluded;
any other languages besides Dutch in which the agreement can be concluded;
the codes of conduct to which the operator adheres and the way in which the consumer can consult these codes of conduct electronically.

Article 5 - Agreement

1.Subject to the provisions in paragraph 4, the agreement takes effect when the consumer accepts the offer and meets the applicable conditions.
2.If the consumer accepts the offer electronically, the operator will immediately confirm receipt of the acceptance of the offer electronically. The consumer can terminate the agreement as long as the operator has not confirmed receipt of the acceptance.
3. If the agreement is concluded electronically, the operator will take appropriate technical and organizational measures for the secure electronic transfer of data, and he will provide a secure web environment. If the consumer can pay electronically, the operator will take appropriate security measures.
4. Within the legal framework, the operator can find out whether the consumer is able to meet his payment obligations, and check on facts and factors that are relevant for the responsible conclusion of the distance contract. If the operator has good reasons, based on these inquiries, to not conclude the agreement, he has the right to refuse an order or request or to make the execution subject to special conditions, with an explanation of the reasons.
5. The operator will include the following information with the product or service for the consumer, either in writing or in such a way that it can be stored by the consumer in an easily accessible manner on a permanent data carrier:
a. The mailing address of the operator's location where the consumer can direct any complaints;
b. The conditions under which and the manner in which the consumer can invoke the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal;
c.Information about warranties and available services after the purchase;
d. the information included in Article 4 paragraph 3 of these terms and conditions, unless the operator has already given this information to the consumer before the execution of the agreement;

Article 6 - Right of withdrawal

1. When a consumer buys a product, he has the right to terminate the agreement without giving any reasons for 14 days. This reflection period starts on the day after receipt of the product by the consumer or by a representative designated and announced to the operator in advance by the consumer.
2. The consumer will handle the product and the packaging with care during the reflection period. He will only unpack the product to the extent that this is needed to be able to determine whether he wants to keep the product. If he invokes his right of withdrawal, he will return the product and all appurtenances - in their original condition and packaging if reasonably possible - to the operator, in accordance with the reasonable, clear instructions provided by the operator.

Article 7 - Costs in the event of withdrawal

1. If the consumer invokes his right of withdrawal, he is responsible for no more than the cost of returning the product.
2. If the consumer has paid a certain amount, the operator will refund this amount within 10 business days, but no later than 30 days after the return or withdrawal.

Article 8 - Exclusion of the right of withdrawal

1. The operator can exclude the consumer's right of withdrawal to the extent provided for in paragraph 2. Exclusion of the right of withdrawal applies only if the operator has clearly stated this in the offer, or at least in a timely manner before the conclusion of the agreement.
2.Exclusion of the right of withdrawal is possible only if the shipment does not meet the following conditions:

The item must be returned unused, unwashed, undamaged, including all attached labels, in the original packaging.
If applicable, the hygiene strip must still be present.
The item must not show signs of wear, such as perfume or smoking or cooking odors.
Returns must have been received at the company's location within 14 days of receipt. Returns can be refused after this date.

Article 9 - Price

1. During the period of validity specified in the offer, the prices of the offered products will not be increased, except for price changes resulting from changes in VAT rates.

Article 10 - Conformity and Guarantee

1. The operator guarantees that the products meet the conditions of the agreement, the specifications listed in the offer, the reasonable requirements regarding soundness and/or suitability and the statutory provisions and/or government regulations in effect on the date of the conclusion of the agreement.
2. A guarantee offered by the operator, manufacturer or importer does not affect the legal rights and claims the consumer can invoke against the operator on the basis of the agreement.

Article 11 - Delivery and execution

1. The operator will take the greatest possible care when accepting and executing orders for products and when assessing requests for the provision of services.
2. The delivery address is the address provided by the consumer to the company.
3. With due observance of the relevant provisions in Article 4 of these general terms and conditions, the company will execute accepted orders promptly and within 30 days at the latest, unless a longer delivery period has been agreed on. If the delivery is delayed or if an order can be executed only in part or not at all, the consumer will be notified no later than 30 days after he placed the order. In that case the consumer has the right to terminate the agreement at no cost.
4. In the event of termination in accordance with the preceding paragraph, the operator will refund the money the customer has paid as soon as possible, but no later than 30 days after the termination.
5. If delivery of an ordered product turns out to be impossible, the operator will make every effort to provide a replacement item. The consumer will be notified no later than the time of delivery, in clear and unambiguous terms, that a replacement item is being delivered. The right of withdrawal cannot be excluded for replacement items.
6. The operator bears the risk of loss and/or damage to products until the time of delivery to the consumer or a representative designated and announced to the operator in advance by the consumer, unless explicitly agreed otherwise.

Article 12 - Payment

1. The consumer is required to notify the operator immediately of any inaccuracies in the provided or reported payment information.
2. In case of non-payment on the part of the consumer, the operator has the right, subject to statutory limitations, to charge the consumer for reasonable costs that have been communicated to the customer in advance.

Article 13 - Complaints procedure

1. The operator has a sufficiently published complaints procedure, and it will handle complaints in accordance with this complaints procedure.
2. Complaints about the implementation of the agreement must be submitted to the operator with a comprehensive, clear description as soon as the consumer notices the defects.
3. The operator will respond to submitted complaints within 14 days, calculated from the date of receipt. If it is foreseeable that a complaint will take longer to process, the operator will respond within the 14-day period with a confirmation of receipt and an indication of when the consumer can expect a more detailed response.
4. If the complaint cannot be resolved amicably, it becomes a dispute that is subject to the dispute settlement rules.

Article 14 - Disputes

1. Agreements between the operator and the consumer to which these general terms and conditions pertain are subject exclusively to Dutch law.

Article 15 - Additional provisions or derogations

Additional provisions to these general terms and conditions or derogations cannot be to the consumer's disadvantage and must be documented in writing or in such as way that they can be stored by the consumer in an accessible manner on a permanent data carrier.
